BAYOU STEEL LAWSUIT

In late September of 2019, nearly 400 employees working in a LaPlace, Louisiana plant lost their jobs when it was suddenly announced that the Bayou Steel plant was closing down. The Bayou Steel plant, located near the Mississippi River produced structural steel and beams and had been a part of the LaPlace, Louisiana community since 1979.

Some of the employees learned of their terminations directly from their supervisors, but most of them heard through word of mouth from other coworkers, through text messages, and even via Facebook.

Since then, Peiffer Wolf has been able to represent these strong Louisiana workers as a result of Bayou Steel’s failure to provide its workers with the notification required under the federal Worker Adjustment and Retraining Notification Act (the “WARN Act”).

Through this lawsuit, we are seeking damages in the amount of sixty (60) days’ pay and benefits, by reason of Defendants violation of the WARN Act. These hard working Louisianans were employees of Bayou Steel for purposes of the WARN Act and were terminated as part of a mass layoff and/or plant closing ordered by Bayou Steel. We believe that Bayou Steel violated federal law by failing to give the former employees of Bayou Steel sixty (60) days advance notice as required by law.

None of the employees received any notice or warning that Bayou Steel was closing their facilities, and the unexpected closure came as a complete surprise to state and local officials. St. John Parish President Natalie Robottom confirmed that neither she, nor the State of Louisiana were given any advance warning.

Generally, the percentage is higher if we are advancing litigation costs and your case does not resolve early.

In most litigation matters, it is extremely difficult – practically impossible – to predict how long or how many hours will it take to resolve a particular case. Every case is different in terms of the complexity. For instance, a simple breach of contract matter is likely to get resolved significantly faster than a complicated lawsuit involving multiple parties, numerous claims, complex issues of law, and extensive discovery. The other parties’ cooperation, the attorneys’ schedules, as well as the number of other cases on the court’s docket are also the factors.
